In 1848, the legislature required that directors of the two existing asylums develop plans and cover the cost of providing treatment of insane persons of color. The legislature allowed each director to determine whether blacks could be accommodated in their institutions or whether they could be treated in separate facilities. The decision was to segregate by race by creating a separate institution. This decision predates the Civil War by twenty years.
